What are F-1 and H-1B visas?

Many Chinese students want to study in the United States. But many students don’t know the difference between F-1 and H-1B visas (also known as h1b签证).  Today we are going to talk about these two important visas for Chinese students. What is the F-1 visa:

An F-1 visa is issued to international students who are attending an academic program or English Language Program at a US school. If you accept an offer of a school, the school would send you the I-20 form (Certificate of Eligibility for Non-immigrant Student Status). Then you can apply for an F-1 visa. Generally, F-1 visa applicants should apply at the US Embassy in their home countries. Many schools require F-1 students to buy health insurance (also known as 留学生 保险).

It is important for F-1 visa holder to remain their status in the US. If a student has bad behavior, such as low GPA, low attendance or cheating on exams, he/she would be dismissed by the school, the F-1 visa would be terminated.

What is the H-1B visa:

The H1B visa is an employment-based, non-immigrant visa for temporary workers. You can apply for an H-1B visa if you have a bachelor’s degree and a job offer from a U.S. company for a specialty position that requires your degree. In addition, the employer must demonstrate that you are to be paid at least the prevailing wage for the position.

Since the H-1B application process and the H-1B reform (also known as h1b改革) is very complicated, you should always consider hiring a lawyer when you apply for an H-1B visa. Remember to check your attorney fees (also known as h1b律师费) before consulting.

Under normal circumstances, an H-1B visa is valid for 3 years and can be extended to up to 6 years. There is an annual limit on how many  H-1B visa petitions are approved each year. The H-1B visa can be transferred to a new employer as long as the new company can file an H-1B transfer visa application on your behalf.
